Notice on behalf of respondent- 1 has been accepted by Chief Standing Counsel.
Issue notice to respondents -2 to 4.
Counsel for the petitioner submits that petitioners have raised a ground before the Consolidation Officer that 1/3rd share in plot no. 26 was purchased by the petitioners which was middle portion of plot. While Sadhu alias Narendra Singh has purchased 1/3rd northern portion of the plot which was uneven land and not suitable for cultivation. In case the petitioners are allotted northern portion then they will suffer grave and irreparable loss. The argument of the petitioners in this respect was accepted by the Settlement Officer Consolidation but the Deputy Director of Consolidation has illegally allowed the revision without considering that land was purchased by the petitioners as well as contesting respondents and northern portion was uneven land and the petitioners were allotted chak in northern portion by the impugned order.
The matter requires consideration.
Till the next date of listing, the operation of the order dated 20.6.2016 remain stayed.
