Bansilal vs State

High Court Of Gujarat|20 March, 2012

JUDGMENT / ORDER

Prima facie, for drawing adverse inference with regard to income of the petitioner, except the Income tax returns, Value Added Tax receipts and Licence issued by the Municipal Corporation permitting the petitioner to carry out business of mobile phones, no other material was placed on record. At the same time, considering the overall facts and circumstances of the case, including the nature of trading activity of selling mobile phones and SIM cards by the petitioner and that the respondent No.2 has to maintain a minor, I am inclined to direct the petitioner to pay Rs.10,000/- pm to respondent-wife and minor, during the pendency of this petition.
Post the matter on 17th April, 2012.
However, it will be open for the parties to explore the possibility of re-union since on perusal of the record, it appears that there are no major issues for matrimonial discord.
