In the present matter, on 21.04.2011 Mr.H.J.Nanavati, learned counsel, made a statement that he has received instructions to appear on behalf of respondent No.3 and time was also sought for to file affidavit-in-reply. Thereafter no affidavit-in-reply is filed.
Today when the matter is called out Mr.H.J.Nanavati, learned counsel appearing for respondent No.3, has tendered a copy of the notice issued to respondent No.3 asking respondent No.3 to make alternative arrangement on account of no instructions in the matter.
Earlier vide order dated 07.03.2011 notice was issued by this Court.
Hence, fresh NOTICE to respondent No.3 returnable on 02.03.2012. Over and above the usual mode of service, the petitioner is permitted to effect service by Regd. Post A.D. at the cost of the petitioner.
