Heard Sri Ravikar Pandey, Advocate holding brief of Sri Rajkapoor Upadhyay learned counsel for the applicants and the learned A.G.A. for the State.
At the very outset, learned counsel for the applicants submits one of the co-accused namely Pradeep was arrested by the Police on 21.03.2018 and then the applicants have to know about the present criminal proceedings initiated by the opposite party no.2.
In the light of the aforesaid, he submits that the interest of justice shall be served in case a direction is issued to the court below to decide the bail application of the applicants expeditiously.
Considering the facts and circumstances of the case, it is observed that in case applicants appear before the court below and apply for bail within two months from today. The court below shall make an endeavour to decide the bail application of the applicants in the light of the observation made in the case of Brahm Singh and Ors. Vs. State of U.P. and Others, reported in 2016 (7) ADJ 151.
With the aforesaid observation, the present application is finally disposed of.
