This appeal is filed against judgment and decree, dated 31-10-2007, in OS.No.5 of 2004 on the file of the Court of the learned I Additional District Judge, Eluru.
Both the parties have filed ASMP.No.565 of 2014 for passing the decree in terms of the memorandum of compromise annexed thereto.
When this case came up before a Division Bench of this Court, the parties were not present at the hearing. Therefore, by Order, dated 24-03- 2014, the Division Bench directed the Registry to transmit the compromise petition to the Mandal Legal Service Committee, Narsapur, West Godavari District, for ascertaining the identity of the parties, who signed the compromise memo, and also the authenticity of the said memo with a direction to retransmit the file to the Court after doing the needful.
The Ex-Officio Chairman, Mandal Legal Service Committee-cum-Additional District and Sessions Judge, Narsapur, has sent report, dated 17-04-2014, along with the compromise memo wherein he has stated that after issuing notice to both the parties, he has identified the parties, who signed the compromise memo.
In the light of the report of the Ex-Officio Chairman, Mandal Legal Service Committee, the appeal is disposed of in terms of the compromise memo annexed to ASMP.No.565 of 2014. The Registry shall draft the decree in terms of the said compromise memo.
ASMP No.565 of 2014 is ordered accordingly.
As a sequel, Miscellaneous Petitions, pending if any, stand disposed of.
