This application u/s 482 Cr.P.C. has been moved on behalf of applicants seeking the quashing of entire proceedings of S.T.. No.754 (State vs. Bangali Babu and others), arising out of Case Crime No.132 of 2013, u/s 307, 452, 325, 504, 506 I.P.C., P.S.-
Naseerpur, District-Firozabad, as well as impugned order dated 7.4.2018 passed by Special Judge, D.A.A., Court No.6, Firozabad whereby application No. 32B dated 12.3.2018 for quashing the entire proceedings of aforesaid case on the basis of mutual compromise, has been rejected.
Heard learned counsel for the applicants and learned A.G.A. Perused the record.
It is apparently clear from the perusal of record that the evidence in the case has already been recorded. At this late stage it does not appear proper to quash the proceedings on the basis of mutual compromise. The offences involved relate to Sections 307, 452, 325, 504, 506 I.P.C. The impugned order does not call for any interference. The matter has to be decided now only on the basis of evidence that has already been produced in the court. The matter relates to non bailable offences. The impugned order or the proceedings do not reflect any illegality or impropriety, much less than any abuse of court's process which may persuade this Court to interfere in the same.
The application stands dismissed being devoid of merit.
