Respondent/Complainant Petition under section 438 of Cr.PC., praying that in the circumstances stated in the memo of grounds file herein, the High Court may be pleased to enlarge the petitioners on bail in the event of their arrest in connection with Crime No.86/2013 of Gudur I Town PS., Sri Potti Sriramulu Nellore District pending investigation and trial.
The petition coming on for hearing, upon perusing the petition and the memo of grounds filed in the Crl.P., orders of the High Court dated: 20-9-2013 and 19-12-2013 made herein, and upon hearing the arguments of Sri CH.C. Krishna Reddy, Advocate for the Petitioners, and the Public Prosecutor for Respondent, the Court made the following.
ORDER:
“This criminal petition, under Section 438 Cr.P.C., has been filed by the petitioners seeking anticipatory bail in the event of their arrest in connection with Crime No.86 of Gudur I Town Police Station, Sri Potti Sriramulu Nellore District, registered for the offences punishable under Section 498-A and Section 3 of Dowry Prohibition Act.
Both the first petitioner/A-1 and the de facto complainant along with their minor son are present before this Court today. They have stated that they are living together since about one month and presently, they are happy.
It is represented that petitioners 2 and 3/A-2 and A-3 have already been granted anticipatory bail by this Court and in pursuance of the same, they have surrendered before the Investigating Officer and executed necessary bonds.
In the circumstances, in the event of arrest of the first petitioner/A- 1, he shall be enlarged on bail on his executing personal bond for a sum of Rs.5,000/- (Rupees five thousand only) with one surety for a like sum to the satisfaction of the arresting officer.
Accordingly, the criminal petition is partly allowed.
