ORDER:
Heard the learned Counsel for the petitioner and learned Standing Counsel for the first respondent.
The petitioner appeared for the EAMCET in the year 2008 and secured a rank of 2594 and got admission in the third respondent-college under A-Category quota. At the time of filing the Writ Petition, he was pursuing first year M.B.B.S. course. The petitioner was stated to be one of the accused in FIR. No.109 of 2010 registered on the file of the Station House Officer, Kadapa I Town Police Station pursuant to disclosure of his name in Crime No. 121 of 2010 on the file of the Central Crime Station, North Zone, Hyderabad was registered against him. The said crime relates to using of electronic gadgets in the EAMCET. The petitioner was arrested on 30.05.2010 and was enlarged on bail by order dated 25.06.2010 by the learned XII Additional Chief Metropolitan Magistrate, Hyderabad. Based on the involvement of the petitioner in the aforesaid crime, he was suspended by the third respondent by proceedings dated 24.07.2010 pending further order from the Director of Medical Education, Hyderabad. Challenging the same, the present Writ Petition was filed.
This Court by order dated 16.8.2010 granted interim suspension, by virtue of which, the petitioner had been attending the college.
In view of interim suspension granted by this Court on 16.08.2010, which is continuing as on to day, this Writ Petition is disposed of directing the third respondent to permit the petitioner to attend the college and take necessary action pursuant to the orders of the Direct or of Medical Education, if any, and criminal proceedings initiated against him.
The Writ petition is accordingly disposed of. Miscellaneous petitions pending consideration if any in the Writ Petition shall stand closed. No costs.
