THE HON’BLE THE CHIEF JUSTICE SRI KALYAN JYOTI SENGUPTA AND THE HON’BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No. 12512 of 2010 ORDER: (Per the Hon’ble the Chief Justice Sri Kalyan Jyoti Sengupta) We feel that the 1st respondent is not described properly, as Government of Andhra Pradesh is not a sue juris. Now it has become State of Telangana, which is a sue juris under Article 300 of the Constitution of India. We therefore direct the registry to amend the name of the 1st respondent as State of Telangana.
Counter affidavit has been filed by respondent Nos.3 to 5. It appears therefrom that serious dispute has been raised with regard to the title of the property. We think this Court is not in a position to decide the same. For this purpose the petitioner can very well approach the land grabbing Court constituted under Section 8 of the Andhra Pradesh Land Grabbing (Prohibition) Act, 1982.
Accordingly, the writ petition is closed giving liberty to the petitioner to approach the Court concerned provided the cause as on today still survives.
Pending miscellaneous petitions, if any, shall also stand dismissed. No order as to costs.
