This application u/s 482 Cr.P.C. has been moved with a prayer that the court below be directed to expedite the trial of Case No. 583 of 2013 (State Vs. Umashankar) arising out of Case Crime No. 226 of 2013, under Section 498A, 323, 504, 506 IPC and 3/4 D.P. Act, P.S. Chandawak, District Jaunpur.
Learned counsel for the applicant contends that this case is pending since 22.5.2013 and till date not even charge has been framed by the court below, hence the above mentioned prayer is made.
Learned A.G.A. has no objection to direction being issued to the trial court to decide this case expeditiously.
Heard learned counsel for the applicant, learned A.G.A. and perused the record.
Perusal of the order sheet indicates that the present case was registered on 22.5.2013 in the court and since thereafter court below has not even framed charges. Therefore, this case is fit case for issuing a direction to the court below to decide this case expeditiously by procuring attendance of the accused- applicant at the earliest.
Accordingly, this application is allowed with the direction to the court below that it shall make an effort to decide this case within a period of one year from today.
With the aforesaid directions, application u/s 482 Cr.P.C. is disposed of.
