Heard learned counsel for the petitioner and learned Standing Counsel.
This petition had been preferred seeking the appointment of the petitioner on the post of Constable (Female) in light of the marks that were liable to be accorded to her in accordance with her High School and Intermediate Examination mark sheets.
Learned Standing Counsel on instructions states that the petitioner has been awarded 405.26 marks on the basis of her performance in the High School and Intermediate Examination whereas the cut off for OBC (Female) was 410.7. It is further pointed out that the marks of the petitioner were computed in accordance with the mark sheet of the High School Examination, which was presented along with the application form. According to the learned counsel this mark sheet was subsequently amended and corrected on 3 June 2017 and produced at the time of document verification. It is further pointed out that all testimonials were liable to be submitted latest by 24 February 2016. Since it is not disputed that the corrected mark sheet was obtained only after the cut off date and produced for the first time only at the stage of document verification, this Court finds no ground to issue the writs as prayed for.
Additionally, the Court bears in mind the sanctity which must necessarily be recognized to stand attached to a cut off date as held by the Full Bench of this Court in Special Appeal No.156 of 2017 (Gaurav Sharma vs. State Of U.P. Thru Secy. And 3 Others) On an overall conspectus of the aforesaid submissions, this Court finds no ground to entertain this writ petition which is accordingly dismissed.
