Heard learned counsel for the petitioner.
This writ petition has been filed seeking the following relief:-
"(i) Issue a writ, order or direction in the nature of mandamus commanding U.P. Ziladhikari Badlapur, District Jaunpur to conclude the proceeding under Section 24 of the U.P. Revenue Code, 2006 pending before him since 7.4.2018 being Case No. T-201814360201586, Bansh Bahadur vs. Gaon Sabha and others within a stipulated period provided by this Hon'ble Court."
In my considered opinion, this writ petition has unnecessarily been filed, especially in view of what has been stated in paragraph 17 of the writ petition. The said paragraph is quoted below:-
"17. That the application under Section 24 of U.P. Revenue Code, 2006 has been moved on 7.4.2018 before respondent no. 2 and measurement and demarcation has been conducted in the presence of both the parties on 12.5.2018 but the case is not being decided by the respondent no.2."
Since it is categorical case of the petitioner that demarcation has already been carried out, the writ petition is sheer abuse of the process of the Court and is dismissed.
