Heard learned counsel for the applicants and learned A.G.A. for the State.
The present third bail application has been filed by the applicants in case crime No.285/15 under Sections 498A, 304B IPC & 3/4 D.P. Act police station Kotwali District Jhansi with the prayer to enlarge him on bail. The first and second bail applications were rejected by this Court vide orders dated 20.11.2013 & 27.03.2017 respectively.
I have perused the prosecution story as set up in the FIR and also the bail rejection order.
It has been contended by learned counsel for the applicants that only one witness of fact has been examined till date and that too has been declared as hostile and the applicants are in jail since 4.8.2012.
There is no subsequent development or any new ground has been brought on record.
After hearing the learned counsel for the applicants, learned A.G.A. and after perusing the averments as contained in the present bail application and also looking to the seriousness of the allegations as made in the FIR, gravity of the offence and severity of the punishment, no case for grant of any indulgence is made out.
Accordingly, the instant third application for bail is rejected. Order Date :- 14.9.2018 Anand
