Petitioners claim to have appointed as Assistant Teacher in L.T. Grade in exercise of power under Section 16-E(11) of the U.P. Intermediate Education Act, 1921 against substantive vacancy. The Inspector has rejected petitioner's claim by observing that substantive vacancy on the post of teacher can be filled only by the U.P. Secondary Education Service Selection Board and any other mode of appointment against substantive vacancy would be void under Section 16(2) of the U.P. Secondary Education Service Selection Boards Act, 1982. The adjudication so made by the Inspector is in accordance with law as laid down by this Court in WRIT-A No.-9003 of 2018 (Dhrub Raj Barnwal and others vs. State of U.P. and Others).
Considering the fact that the appointments of the petitioners are, otherwise, shown to be in teeth of section 16(2) of the Act of 1982, this Court is not inclined to interfere with the order impugned.
The writ petition is, accordingly, dismissed.
