This writ petition is essentially directed against the order dated 8.8.2019 refusing to release the vehicle in Case Crime No.31 of 2019 under sections 60/63/72 of Excise Act and Sections 419,420,467,468,471 IPC P.S. Sahjanwa District Gorakhpur.
Learned A.G.A, rightly submitted that against the order impugned, the petitioner has an alternative remedy under Section 72(7) of the U.P. Excise Act, the writ petition is liable to be dismissed.
The writ petition is dismissed on the ground of alternative remedy.
The office is directed to return the certified copy of the order impugned to the learned counsel for the petitioner after retaining a xerox thereof.
