The petitioner has prayed for a direction to the trial court to decide Original Suit No.93 of 2015 within a specified time frame.
Perusal of the record reveals that an application under Order 9 Rule 4 CPC (Misc. Case No. 58 of 2018) is pending. Meaning thereby that the suit stands dismissed in default. Thus, the prayer made in the petition is wholly misconceived.
The petition is accordingly disposed of with liberty to the petitioner to file fresh petition with appropriate relief.
