Heard Sri Akhil Kumar Shukla, learned counsel for the revisionist and learned A.G.A. for the State.
This revision has been filed for quashing impugned judgement and order dated 22.1.2018 pased by learned Additional District and Sessions Judge, Court No.3, Kannauj in Sessions Trial No.321 of 2014 (State Versus Balvir and others) arising out of Case Crime No.132 of 2013 under Sections 323, 504 and 308 I.P.C., P.S. Talgram, District Kannauj.
The present revision arises out of rejection of an application moved by the revisionist for recalling PW1, PW2 and PW 3 as some important questions have been left out to be put to witnesses in cross-examination. The trial court has recorded in the impugned order that accused were afforded full opportunity for cross-examination and witnesses cannot be recalled for filling up lacuna of defence.
After having heard the learned counsel for the parties present and perused the impugned order as well as material brought on record, I am of the view that the impugned is based upon relevant consideration and supported by cogent reasons, the same does not suffer from any irregularity, illegality or jurisdictional error, hence, no interference is required by this Court. The prayer for quashing the impugned order is refused.
The revision lacks merit and is, accordingly, dismissed.
