This Application has been preferred under Section 439 of the Code of Criminal Procedure, 1973 in connection with the offence being CR No.I-300 of 2011 registered with Naroda Police Station, Ahmedabad for the offences punishable u/s. 307 and 427 of the IPC and under Sections 3 and 7 of Damage to Public Property Act and under Section 30 of the Arms Act.
Earlier the applicant had preferred bail application being Criminal Misc. Application No.14644 of 2011 and this Court has rejected the said bail application by detailed order dated 17.10.2011. From the perusal of the application, no new ground is stated by the applicant for entertaining this application.
Learned advocate Mr. Kamal Sojitra submitted that the applicant wants to approach the Hon'ble Supreme Court against the present order. He submitted that the applicant is in jail since long period and trial is not yet commenced.
The applicant is at liberty to move the Hon'ble Supreme Court.
The application is disposed of. Rule is discharged.
