Heard learned counsel for the applicant.
The applicant is before this Court for a direction to initiate contempt proceeding against the opposite parties for willful disobedience of the order dated 13.04.2006 passed in Second Appeal No.343 of 2006 (Balveer Singh Vs. Jagat Singh and others).
After some arguments, learned counsel for the applicant prays for withdrawal of the present contempt application with liberty to file fresh application under Order XXXIX Rules 2-A of Code of Civil Procedure in pending Second Appeal.
Accordingly, the present contempt application is dismissed as withdrawn with liberty as prayed.
