Ms.Shah, learned APP, waives service of rule on behalf of the respondent-State.
The applicant-convict, by this application, has prayed that he be enlarged on temporary bail since he wants to arrange for fine which is imposed by the learned Sessions Judge so that he need not remain in jail for default sentence.
It is to be noted that the applicant's sentence is for 10 years R.I. and that period is yet to be over. Further the applicant was already on furlough leave for the period from 8th January, 2012 to 21st January, 2012.
Considering these aspects, the discretion does not deserve to be exercised.
Hence, application is dismissed. Rule discharged.
