(Per : HONOURABLE MR.JUSTICE V. M. SAHAI) 1 We have heard learned Advocate R.D. Dave for the appellants, learned AGP Ms. Jirga Jhaveri for respondents No. 1 and 2 and Mr. Asist M. Mehta, learned Advocate for respondent No.3.
2 The learned Single Judge has dismissed the petition vide order dated 12.12.2011 on the ground that reduction of guachar land should not have been objected by any one much less the so called public spirited citizens- appellants/petitioners and further held that the appellants/petitioners have an alternative remedy of filing revision application before the State Government.
3 In our opinion, the learned Single Judge has not committed any illegality in dismissing the writ petition and no interference is warranted. Hence, the appeal deserves to be dismissed and stands dismissed accordingly. However, sofar as the imposition of cost of Rs. 30,000/- is concerned, that part of the order is set aside.
4 In view of the order passed in appeal, the Civil Application No. 940 of 2012 has no survival value and stands dismissed accordingly.
