Petitioners were engaged as Stenographers in the department of Education and have already retired after attaining the age of superannuation. They have raised grievance regarding denial of third promotional pay scale under the ACP scheme, upon successfully completion of 26 years service. Further grievance is that grade pay admissible to them have also not been provided without any justification. Attention of the Court has been invited to the fact that persons junior to petitioners have been granted grade pay of Rs.5400/- but the same benefits are denied to petitioners. Reliance is also placed upon a Government Order dated 29th March, 2018. Various representation made in that regard have not been considered, and hence this writ petition.
Learned Standing Counsel submits that grievance of petitioners shall be examined by the competent authority, in accordance with law.
In the facts and circumstances, noticed above, this writ petition stands disposed of with a direction upon the respondent no.3 to accord consideration to petitioners' claim, as noticed above, in accordance with law, by passing a reasoned order, within a period of four months from the date of presentation of certified copy of this order.
