Heard learned counsel for the applicant, learned AGA and perused the record.
By means of this application, the applicant who is involved in case crime no. 1085 of 2015, under Section 304 IPC, P.S. Marrdaha, District- Hamirjpur is seeking enlargement on bail during the trial.
Learned counsel for the applicant in support of his application for bail submits that the applicant is innocent. He has been falsely implicated in the present case. The rejection order dated 22.05.2017 shows that as many as four witnesses were examined during the trial and since 15.01.2017 the applicant is in jail. The trial is in the last stage.
Under the circumstances, at this stage I do not find any good reason to grant indulgence to the applicant. Consequently, the bail application is rejected.
The trial court is directed to gear up the trial of S.T. No. 195 of 2015 (State Vs. Rakesh Singh @ Bhura and others) pending in the court of Additional Sessions Judge (F.T.C.) Ist, Hamirpur and conclude the same by 30.04.2018, if possible. Even if, he fails to do so, the learned counsel for the applicant can move a fresh bail application of the applicant before the Court.
Let a copy of this order may be served by the office to the court concern within 15 days from the production of certified copy of this order.
