Heard Sri I.K. Chaturvedi, learned Senior Counsel assisted by Sri Ram Milan Dwivedi, learned counsel for the appellant as well as learned A.G.A. for the State and perused the record.
It is submitted by learned counsel for the appellant that the appellant is a labour and he had gone Delhi to earn his livelihood due to which neither he could appear before this Court nor he could inform to his previous counsel due to which non-bailable warrant has been issued against the appellant. The appellant has been arrested on 19.03.2019 and now he is in jail. He further submitted that he is ready to argue the case on merit and he will not seek any unnecessary adjournment.
Considering the facts and circumstances of the case, in our view, the appellant may be released on bail.
The bail application is allowed.
Let the appellant (Balkishan) convicted in Sessions Trial No.
34 of 1989, under Section 302 I.P.C., P.S.- Rath, District Hamirpur, be released on bail on his furnishing a personal bond of Rs 10,000/- and two sureties each in the like amount to the satisfaction of the C.J.M. concerned.
The photo copy of bail bonds so furnished be transmitted to this Court.
On the request of learned counsel for the appellant, put up on 14.10.2019 for final hearing.
