The applicant is before this Court for a direction to initiate contempt proceedings against the opposite party for willful disobedience of the order dated 11.3.2010 passed in Writ C No. 5423 of 2007. For ready reference, the operative portion of the said order is quoted as under:-
"The writ petition has no merit and it is, accordingly, dismissed.
However, in case fresh allotments are made, the dismissal of this writ petition shall not preclude the Land Management Committee from considering the petitioners' claim for fresh allotment and the Land Management shall take steps for making fresh allotments in respect of the land to the petitioners as admitted and till date such fresh allotments are made, parties shall maintain status quo as on date with regard to the land in dispute. "
The Court has proceeded to examine the record in question and finds no reason or occasion calling upon any proceeding against the opposite party under Section 12 of the Contempt of Courts Act, 1971 at this stage.
Once the Court has declined to interfere, learned counsel for the applicant requests that he does not want to press the present contempt application and the same may be rejected as withdrawn with the liberty to file a fresh application.
The contempt application is accordingly rejected as not pressed, at this stage.
