The petitioner has confined his case to the relief no. 2 in the writ petition which refers that representation to be decided by the authorities concerned, pending since 23.10.2007. The claim of the petitioner is as per the pleadings regarding certain dues which have not been cleared even though the petitioner has been in service though on daily wage basis as Assistant Operator since 25.05.1992. The petitioner claims that he is entitled to the salary in the pay scale of Rs. 430-468 along with other allowances with consequential benefits including regularization.
In view of the fact that writ of mandamus is sought and there is no order by the authority concerned, it is necessary that the matter be examined at the first instance at the level of respondent no. 5. I, therefore, direct the respondent no. 5 to consider the claim of the petitioner, if any, admissible in law as contained in representation dated 23.10.2007 and also consider any such representation that may be moved by him within a period of three weeks from today regarding the benefits for which he is entitled. In the event, such an application is being preferred, the same shall be considered and decided by the authority concerned strictly in accordance with law within a further period of three months from the date of production of a certified copy of this order.
The writ petition is disposed of with the aforesaid directions/ observations.
