Heard Sri Balram Mishra, learned counsel for the applicant and Sri Amit Sinha, learned AGA for the State.
This application under Section 482 of Cr PC has been filed by the applicant, seeking quashment of entire proceeding of Criminal Case No.5949 of 2015, arising out of Case Crime No.0823 of 2015 (State Vs. Vindhyachal and others) under Sections 147, 323, 504, 452, 506, 352, 379 of IPC, Police Station Dhanghata, District Sant Kabir Nagar, pending in the Court of Chief Judicial Magistrate, Sant Kabir Nagar.
After arguing the matter for some time, learned counsel for the applicant wants to withdraw this application with liberty to file regular application seeking bail before the trial Court. He submits that a direction may be issued to the trial Court to decide the bail application expeditiously, so that the applicant may not suffer any further injury.
State counsel, however, submits that discretion be given to the trial Court to decide the bail application in accordance with law.
This application is accordingly, dismissed, as withdrawn with the aforesaid liberty.
Needless to state that in the eventuality of filing any such application, the competent Court shall decide the same strictly in accordance with law.
