By means of the present application, the prayer sought by the applicant is to give a direction to the court below for expeditiously disposal of Case No.2394 of 2017 (State vs. Shahid and others) arising out of Case of Case Crime No.556 of 2010 under sections 498A, 323, 324 I.P.C. and 3/4 Dowry Prohibition Act PS. Kutbsher, District Saharanpur.
Learned counsel for the applicant submitted that the applicant is informant of Case Crime No.556 of 2010 under sections 498A, 323, 324 I.P.C. and 3/4 Dowry Prohibition Act PS. Kutbsher, District Saharanpur. After making investigation, police submitted charge sheet on 11.4.2011 and cognizance was taken on 30.6.2011. The trial of the case is still proceeding at snail's pace. The aforementioned case is pending since the year 2011 and the only prayer made by the applicant is to give direction to the court below to expedite the trial.
Keeping in view that the matter relates to the year 2011, it is expected from the learned trial court to proceed with the case and make all necessary endeavour to conclude the trial within a period of two years without granting unnecessary adjournment to either of the parties., strictly following the provisions of Section 309 Cr.P.C., if there is no legal impediment.
With the aforesaid directions, this 482 Cr.P.C. application is finally disposed of.
