Petition under Section 438 of CR.P.C., praying that in the circumstances stated in the petition and the grounds filed herein, the High Court may be pleased to enlarge the petitioners on Bail in the event of the Respondent/Police arresting the Petitioners/A-3 & A-
4 in Crime NO. 293 of 2013 of Eluru Rural Police Station, in the interest of justice.
The petition coming on for hearing, upon perusing the petition and the grounds filed herein, and upon hearing the arguments of Sri C.S.N. Raju, Advocate for the Petitioners and of the Public Prosecutor on behalf of Respondent- State, the Court made the following.
ORDER:-
“Petitioners are A3 and A4. They seek for grant of anticipatory bail. They allegedly committed offences under Sections 324, 354, 448 and 506 read with Section 34 IPC.
The learned Additional Public Prosecutor submitted that investigation is still in progress. However, A2 had already been enlarged on anticipatory bail by me. A1 and A6 would appear to have been enlarged on bail. I consider that the petitioners stand on the same footing as A2. The petitioners therefore deserve to be enlarged on anticipatory bail.
Consequently, this Criminal Petition is allowed. The petitioner shall surrender before the learned Special Judicial Magistrate of First Class (Excise) at Eluru, West Godavari District, within two weeks from today. On such surrender, the learned Special Judicial Magistrate of First Class (Excise) at Eluru, West Godavari District shall enlarge the petitioner on bail on a personal bond of Rs. 10,000/- (Rupees Ten Thousand Only) with two sureties in a likesum to his satisfaction.”
