[1] This Civil Application is filed under Section 5 of the Limitation Act to condone delay of 1360 days occurred in filing Cross Appeal.
[2] It is submitted by Ms.Ajmera, learned advocate for the applicant that award impugned which is challenged in this appeal is also challenged by other claimants as well as State Government by way of preferring appeals and those appeals are admitted by this Court. It is further submitted that as the applicant was unable to manage funds and as he is illiterate, cross appeal could not be filed in time.
[3] Having heard learned advocates for the respective parties and taking into consideration averments made in the application and in the peculiar facts and circumstances of the case, the application is allowed. Delay caused in filing cross appeal is condoned.
