Heard Sri Surya Prakash Singh, learned counsel for the petitioners, Sri Manish Mishra, learned Standing Counsel appearing for the State and perused the material brought on record.
The present writ petition has been filed by the petitioner, namely, Baldev Singh with the following prayer"
"(i) Issue a writ, order or direction in the nature of mandamus commanding the opp. parties to restrict the cultivation of summer paddy in the District Lakhimpur Kheeri, Uttar Pradesh.
(ii) Issue a writ, order or direction in the nature of mandamus commanding the opp. parties to decide the representation moved by the petitioners, which is still pending before the opp. parties as contained in Annexure-2 to this writ petition"
Learned counsel for the petitioners submits that the petitioners have already made a representation agitating their grievance to the District Magistrate, Lakhimpur Kheeri, respondent no.3, on 24.02.2021 (Annexure-2) and the same is pending till date.
After having heard learned counsel for the parties, we are of the opinion that the petitioners may approach the District Magistrate, Lakhimpur Kheeri, respondent no.3 by making a fresh representation ventilating their grievance within a period of three weeks from today and if the such representation is made, the same shall be decided by the authority concerned in accordance with law preferably within a further period of six weeks after providing opportunity hearing to all the the parties concerned, if the representation of the petitioner dated 24.02.2021 has already not been decided by the District Magistrate, Lakhimpur Kheeri, respondent no.3.
With the aforesaid direction, the present writ petition stands disposed of.
The party shall file computer generated copy of order downloaded from the official website of High Court Allahabad, self attested by it alongwith a self attested identity proof of the said person (s) (preferably Aadhar Card) mentioning the mobile number (s) to which the said Aadhar Card is linked.
The concerned Court/Authority/Official shall verify the authenticity of the computerized copy of the order from the official website of High Court Allahabad and shall make a declaration of such verification in writing.
