Heard learned counsel for the applicants and perused the record.
The applicants have preferred the present contempt application for non- compliance of the final judgment and order dated 08.07.2019 passed in Writ Petition No. 3947 of 2019 (Balbir Singh & 16 others vs. State of U.P. and 4 others). The order dated 08.07.2019 is reproduced herein below:-
"The principal prayer made in the instant petition is for issuing direction to the court below before whom Land Acquisition Reference No.29 of 2015 is pending, to decide the same within stipulated period. The petitioners have also prayed for release of compensation amount to them which is under deposit.
Learned counsel for the petitioners points out that the Reference is under Section 30 of the Land Acquisition Act, 1894. It is submitted by him that the respondent has already been duly served but he is not entering appearance in order to delay the disposal of the proceedings.
Having regard to the facts of the case and the submissions made, the instant petition is disposed of by directing the trial court to make serious endeavour to decide the Reference expeditiously by fixing short dates and without granting unnecessary adjournments to the parties."
It is argued by learned counsel for the applicants that though a considerable time has elapsed from the date of passing of the aforesaid judgement and order, the matter is still pending consideration before the court below.
The present contempt application is disposed of finally by directing the court below to hear the Land Acquisition Reference No. 29 of 2015 and pass appropriate orders in the matter as directed by this Court, quoted above, in accordance with law expeditiously, preferably within a period of one year, after providing opportunity of hearing to all parties concerned.
The contempt application is disposed of finally.
