Heard learned counsel for the petitioner; learned A.G.A. for the respondents no. 1, 2, 3, 4 and 5; and perused the record.
The learned A.G.A. has raised a preliminary objection as regards the maintainability of the petition as Cri. Misc. Writ Petition inasmuch as till date no First Information has been lodged and, therefore, it should be properly classified and placed before the appropriate Bench.
The learned counsel for the petitioner has not been able to demonstrate that any First Information Report has as yet been lodged. Under the circumstances the office shall classify the petition as a Civil Misc. Writ Petition and place the same before appropriate Bench, if possible, in the next week.
