No one appears to press the petition on behalf of the petitioner even in the revised call.
The present proceedings arise from an order dated 1.3.2007 passed by the Civil Judge (Junior Division) Shikohabad in Original Suit No.577 of 2003 (Balbir Singh Vs. Daya Shanker) rejecting the application filed by the petitioner for impleadment of one Ahibaran Singh, the Court below rejected the said application holding that the applicant was not bona fide nor was it necessary for determination of the real question in dispute. There is nothing on record to demonstrate as to how the said person was either a necessary or a proper party. The revision against the said order has also been dismissed.
The writ petition lacks merit and is dismissed accordingly. Interim order dated 4.3.2009 is vacated.
