This Writ Petition is filed for a Mandamus to set aside the proceedings in Ref.D/596/2014, dated 28.07.2014, of respondent No.3, whereby he has suspended the petitioner's fair price shop authorization in respect of Fair Price Shop No.34 of Tallapaka Village, Rajampet Mandal, YSR Kadapa District.
I have heard Sri V.R.Reddy Kovvuri, learned counsel for the petitioner and the learned Assistant Government Pleader for Civil Supplies (Andhra Pradesh).
A perusal of the impugned proceedings shows that based on an inspection made on 07.07.2014, wherein certain variations were allegedly found in the essential commodities such as rice, sugar, atta, RG dal and wheat, the petitioner's fair price shop authorization has been placed under suspension.
Considering the fact that the impugned order of suspension was passed more than three months back pending enquiry, I am not inclined to interfere with the same at this stage. However, respondent No.3 is directed to complete the enquiry, wherein the petitioner shall be given a fair opportunity of being heard, and pass a final order within a period of two months from the date of receipt of a copy of this order.
Subject to the above directions, the Writ Petition is disposed of.
As a sequel, WPMP.No.41140 of 2014, filed by the petitioner for interim relief, is disposed of as infructuous.
