1. In response to the notice issued, learned advocate, Ms.Lilu K. Bhaya appears for the respondent - DGVCL and stated on instructions that Chairman, DGVCL shall appoint an arbitrator in terms of Clause No.37 of the agreement between the parties. She also stated that essential will be done within a period of 15 days from today.

2. On such statement, learned counsel for the petitioner seeks permission to withdraw the petition.

3. Permission is granted. Liberty to apply in case of difficulty. Petition stands disposed of accordingly. Notice is discharged.
