This application under Section 482 Cr.P.C. has been filed with a prayer that the order dated 19.12.2009 issuing non bailable warrant against the applicants may be quashed and the further proceedings of the case may also be stayed.
I have perused the record. It appears that vide order dated 26.06.2009 the accused applicants was summoned for the offences under Sections 147, 323, 354, 452, 504, 506 I.P.C. The applicants have filed the ordersheet dated 19.12.2009 in which it has been mentioned that the applicants are absent. Thereafter non bailable warrants were issued aginst them. The case was fixed for 16.01.2010. The order sheet in between the dates 26.06.2009 and 19.12.2009 have not been filed. It appears that the summons were served upon the applicants and they did not appear in the Court, hence, non bailable warrants have been issued against them. In these circumstances question of quashing the order dated 19.12.2009 does not arise. The applicants may surrender in the Court of Magistrate within a week. Till then no coercive method will be adopted for procuring attendance of the applicants.
The application is finally disposed of.
