(Per : HONOURABLE MR.JUSTICE RAVI R.TRIPATHI) Learned Additional Public Prosecutor Mr.H.K. Patel places on record a copy of statement of the convict recorded on 19th June 2012, wherein it is stated that the convict's father has expired about 10 days before. The present application is filed, through Jail, seeking temporary bail for a period of 30 days so as to undertake the required procedure for making mutation entry in agricultural land.
2. RULE.
Mr.H.K. Patel, learned Additional Public Prosecutor waives service of rule on behalf of the respondent-State.
3. The applicant- appellant- original accused has been convicted for the offences punishable under sections 302 and 34 of the Indian Penal Code and section 135 of th Bombay Police Act to undergo imprisonment for life with fine of Rs.2100/-, in default to further undergo imprisonment for 6 months and 15 days as awarded vide judgement dated 31st December 2008 by the learned Additional Sessions Judge, Sessions Court, Navsari in Sessions Case No.30 of 2008.
4. The learned APP has invited attention of the Court to the Jail remarks. The convict has undergone 4 years and 3 months in Jail as on 13th June 2012. The convict had enjoyed furlough on one occasion in the month of March 2010. He has reported in time.
5. For the contents of the application, the same is allowed. The convict is ordered to be released on temporary bail for a period of 30 (thirty) days from the date of his release on his executing a personal bond of Rs.5000/- (Rupees five thousand only) to the satisfaction of the Jail authorities.
6. The convict shall surrender himself to the Jail authorities on expiry of the above temporary bail period. The application is allowed. Rule is made absolute.
