Heard learned counsel for the applicant.
The petitioner has pleaded violation of order of writ Court dated 27.11.2018 with the assertion that despite a categorical direction issued by this Court for passing an order after looking to the claim of the petitioner, the District Magistrate, Mau did not execute contract in favour of the petitioner though the bid submitted by the petitioner was lowest, nor any speaking order has been passed for rejection of claim of the petitioner.
On a pointed query made by the Court, learned counsel for the petitioner informs that no contract for hiring of Taxi for DHS-NHM for District Mau under the scheme promulgated by National Health Mission scheme has been executed by the District Health Society in favour of any other person. The Court cannot insist the executives to execute a contract, if it they decide not to do so.
In the said scenario, this Court is of the considered view that no case is made out for contempt.
It is open for the petitioner to plead his claim before the appropriate authority, who shall do the needful.
The contempt application is, accordingly, disposed of. Order Date :- 29.1.2019 Brijesh
