(ORAL) This writ petition has been filed by the subsequent allottee, who was appointed after the cancellation of fair price shop licence of respondent No. 3, Harish Chandra Sonkar, son of Anantu.
Learned counsel for the petitioner states that the Appellate Authority has over looked two reports and finding of the learned Trial Court i.e. the Licensing Authority and has set aside the order of cancellation dated 04.04.2016 and has restored the fair price shop licence of respondent No. 3 in Appeal by his order dated 27.01.2018.
It is settled law that the subsequent allottee has no right to challenge the restoration of licence of the erstwhile licensee. He will be a person annoyed, but he is not person aggrieved as his licence was granted to him only after cancellation of fair price shop licence of the erstwhile licensee.
The writ petition is dismissed. No order as to costs.
