JUDGMENT / ORDER

Heard Shri A.K. Srivastava, learned counsel for the petitioner.
The petitioner has come up against the order dated 04.02.2003.
The contention raised is that no departmental proceeding was initiated and it is only when the Vigilance Officer met the petitioner then he came to know of the said prosecution, which is sought to be launched under the impugned order.
There is no requirement of law of giving a previous notice before launching of any proceedings under any rule for the time being in force. Even otherwise, the impugned order is of the year 2003. Merely because no departmental proceedings were initiated and notices issued, the same cannot take away the impact of the order, which is now sought to be challenged.
The writ petition is full of latches and the same is dismissed.
