Heard Sri V.M. Jaidi, learned Senior Advocate in support of this application assisted by Sri Karunesh Pratap Singh and Sri M.J. Akhtar, Sri Om Prakash, the learned A.G.A. for the State and perused the record.
The present bail application has been filed by the applicant in Case Crime No. 214 of 2019 (S.T. No. 474 of 2019, under Sections 147, 148, 302, 323, 504, 506, 120-B I.P.C., Police Station Gola, District- Gorakhpur with the prayer to enlarge him on bail.
For the purposes of evaluating the prayer for bail, the Court notes that the applicant has been chargesheeted for commission of offences under Sections 147, 148, 302/149, 323/149, 504, 506, 120-B I.P.C. Presently, the Court notes that the trial has commenced and reliance is placed on the statement of P.W. -1 to submit that the grevious injury is attributed to one Akhilesh Maurya. In view thereof, it is submitted that the applicant may be enlarged on bail. However, the Court notes that the trial is at the initial stage and that the charges levelled against the applicant are not confined to Section 302 I.P.C. It would therefore be appropriate for further evidence be laid in trial before evaluating the prayer for bail that is made.
Accordingly, prayer for bail is dismissed at this stage.
