Heard Shri Pradeep Kumar Rai, learned counsel for the petitioner and Shri Dhirendra Singh, Brief Holder for the respondents no. 1 to 6. Shri Rajesh Yadav has accepted notice on behalf of respondent no. 7.
The petitioner is seeking a direction to the respondents to restore the chak road Khata No. 92 situated in village Nirmana Tehsil Sadar District Muzaffar Nagar. The relevant extract of the revenue record has been filed as Annexure-1 to the writ petition. In this regard it is stated that the petitioner has made a representation before the District Magistrate on 17.10.2017 by registered post, Annexure-4 to the writ petition but no orders have been passed thereon.
No useful purpose would be served in keeping this writ petition pending.
This writ petition is therefore disposed of with a direction that in case the petitioner prefers a fresh representation before the respondent no. 2-District Magistrate/Collector, District Muzaffar Nagar within fifteen days from today alongwith certified copy of this order raising all his grievance as raised in the writ petition, the same shall be considered and decided by the respondent no. 2 in accordance with law within a further period of two months.
It is made clear that the court has not decided the claim of the petitioner on merit.
