Heard learned counsel for the petitioner, Sri Y.S. Bohra, learned counsel who appears for the Basic Education Officer as well as Sri Piyush Shukla, the learned Standing Counsel for the State respondents.
The petitioner appeared in the Assistant Teachers Recruitment Examination, 2019 but could not qualify on account of the low quality point marks that he received. The present petition which seeks the issuance of a direction commanding the respondents to consider his candidature afresh is based on the following averments.
"10. That, despite having secured marks above the cutoff marks under his category, petitioner was not selected because he could not compete in securing the weightage on the basis of academic education. The reason for the same was that the petitioner passed his High School in year 1995 and Graduation in year 2000. It is matter of common knowledge that earlier the percentage of marks remained much below than the marks being given nowadays. Earlier even 70-75% marks were treated as meritorious and students were above to obtain good remarks for various reasons, but nowadays the students easily obtain above 90% marks."
From the aforesaid, it is manifest that the writ petition is thoroughly misconceived and is in abuse of the process of Court.
Consequently, the petition is dismissed with costs quantified at Rs.5,000/-.
