Order on Civil Misc. Substitution Application No. 9 of 2018 along with Civil Misc. Delay Condonation Application No. 8 of 2018:
Cause shown in the Affidavit filed in support of the Delay Condonation Application in preferment of the instant Substitution Application is found to be sufficient. The Delay in filing the same is condoned. The Delay Condonation Application is consequently allowed.
Substitution Application is allowed. Let appropriate amendments in the cause title be carried out forthwith.
Order on Writ Petition:
This petition has been preferred challenging an order dated 28 March 2003. Although that is described to be an order all that is brought on the record is an endorsement stated to have been made by the Sub Divisional Magistrate directing parties to maintain status quo. The only other order which has been placed on the record is one entered at page – 2, which also bears a date of 28 March 2003 on which the Sub Divisional Magistrate has accepted a report. In that view of the matter, the Court finds that no rights of parties as such has been determined and that in any case it shall be open for the respective parties to establish their claims in the proceedings pending and referable to Section 229B of the U.P.Z.A. & L.R. Act, 1950.
The petition stands disposed of in the above terms.
