This petition is preferred to have a writ, order or direction for respondent nos.4 and 5 to pay the interest at the rate of 12% per annum on delayed payment to the petitioner.
Factual matrix of the case is that under a work order dated 21st March, 2018, the petitioner was assigned the work to realize the parking tax for a period from 1st April, 2018 to 31st March, 2019. The petitioner was entitled to have the amount of Rs.34,37,500/- against the work done and the work done was further enhanced by 19%.
As per the petitioner, the respondents paid a sum of Rs.14,55,046/- to the petitioner on 28th August, 2018 i.e. delayed by about six months. On the basis of delay aforesaid, the petitioner is claiming interest at the rate of Rs.12% per annum.
Looking to the nature of dispute, we are not inclined to entertain this petition for writ. The petitioner is at liberty to agitate its cause by availing appropriate remedy including the remedy of civil suit before the competent civil court.
The writ petition is dismissed.
