The petitioner has preferred this writ petition for issuance of a writ of certiorari to quash the order dated 24th June, 2010 passed by the Chief Executive Officer, UPEIDA, and order dated 25th July, 2010 passed by the Collector, Farrukhabad. The petitioner has also sought a direction upon the respondents not to interfere in the peaceful running of brick kiln of the petitioner.
No one is present to press this writ petition even in the revised call.
Learned Standing Counsel states that the counter affidavit has been filed long back but no rejoinder affidavit has been filed.
We have perused the material on the record. In the matter of brick kiln the Supreme Court has issued certain directions. In compliance therewith, the State Government has taken a policy decision and the Government orders/ circulars have been issued from time to time. It appears that in view of those developments the writ petition has become infructuous by efflux of time. We do not find any application for hearing of this matter. We find that either the cause of action does not survive or the petitioner has lost interest to pursue the matter.
In view of the above, the writ petition is, accordingly, dismissed leaving it open to the petitioner to move appropriate application in case cause of action still survives or this order causes any prejudice to the interest of the petitioner.
No order as to costs.
