1. Rule.
Learned counsel for the respondents waive service. Though served, none appears on behalf of respondents no.1, 2, 4 & 5.
2. This petition has been preferred against the order dated 05.09.2011 passed by respondent no.1-authority in Revision Application No.117/2011 whereby, the revision application was rejected and the order passed by the Addl. Registrar (Appeal) dated 08.10.2008 was confirmed.
2. During the course of hearing, a consensus was arrived at between the parties, which was in the interest of the members of the Society and also the Society individually. On the basis of such consensus, the following direction is issued;
(a) The petitioner as well as respondent no.5 will hand over the entire administration of the Society, along with all records, to the District Registrar, Dang on or before 31.07.2012.
(b) After such handing over of administration and the records, the District Registrar shall fix the programme for Elections of the Society, which shall be completed within a period of Three Months from the date of handing over of the administration.
(c) After the Election Programme is finalized, the District Registrar shall ascertain Members of the Society and shall publish the provisional Voters' List.
(d) The District Registrar shall invite objections, if any and after considering the same, shall publish the final Voters' List. Thereafter, on the fixed date, the Elections shall be held.
(e) The results of the Election shall be declared within the period stipulated herein above and thereafter, the administration, along with the entire record, shall be handed over to the party, which succeeded in the said Election.
3. With the above directions, the petition stands disposed of. Rule is made absolute to the above extent.
