Heard learned advocate for the petitioner. Learned counsel for the petitioner has invited this Court s attention the order dated 10/7/2012, passed by this Court in Special Civil Application No. 14206 of 2011, the operative portion of that order is set out as under:
(e) The results of the Election shall be declared within the period stipulated herein above and thereafter, the administration, along with the entire record shall be handed over to the party, which succeeded in the said Election.
3. With the above directions, the petition stands disposed of. Rule is made absolute to the above extent.
The results are declared on 30/10/2012 as scheduled. The communication was sent on 1/11/2012 with a request to handover the charge, and the Society s by-laws provides for making appointment by way of nomination of the remaining posts in the committee.
Therefore, let there be a notice for final disposal returnable on 30/1/2013. It is expected of the respondents to file their reply by the returnable date, failing which, it would be open to the petitioner's counsel to request for mandatory order and praying for allowing the petition on the strength of the averments made in the petition.
