These two Civil Revision Petitions are directed against the common order dated 11-07-2014 passed in I.A.No.540 of 2014 and I.A.No.541 of 2014 in MVOP.No.238 of 2012 on the file of IX Additional District Judge, Wanaparthy, whereby and whereunder the Court below dismissed the petitions filed for reopening the main O.P. and for issuance of summons to Additional Licensing Authority, Mahabubnagar to produce evidence in respect of driving licence bearing NoDLR AP022239972009 of driver of crime vehicle.
2. Learned counsel for the petitioner submits that issuance of summons to Additional Licencing Authority, Mahabubnagar is for furnishing driving licence particulars of the driver of the crime vehicle and for just decision of the matter and that the petitioners have taken such a defence. But, the Court below, without considering the same, rejected the said applications.
3. Learned counsel appearing for the respondents states that he has no objection for allowing the Civil Revision Petitions, while requesting the court to direct the court below to fix a time for production of evidence.
4. Having regard to the facts and circumstances of the case, without going into the merits of the case, I deem it appropriate to direct the Court below to fix a date for taking evidence of Additional Licencing Authority in respect of driving licence particulars of the driver of the crime vehicle and dispose of the main O.P., expeditiously as possible, preferably within a period of two (2) months from the date of receipt of a copy of the order.
Accordingly, the Civil Revision Petitions are allowed setting aside the common order dated 11-07-2014 passed in I.A.No.541 of 2014 and I.A.No.540 of 2014 in M.V.O.P.No.238 of 2012 on the file of IX Additional District Judge, Wanaparthy. There shall be no order as to costs.
As a sequel thereto, Miscellaneous Petitions, if any, pending shall stand closed.
